29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501:    a) SK Construction Inc. at 3060 West 29th Avenue Boulder, CO 80301:  On or before 12/12/17, the employer did not ensure that employees were protected from fall hazards while performing construction on residential property. An employee was performing siding work on a two story residential roof without the use of fall protection.  An employee sustained serious injuries when he fell 19.5 feet from the roof to the sidewalk.  This condition exposed employees to fall hazards of approximately 19.5 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) SK Construction Inc. at 3060 West 29th Avenue Boulder, CO 80301:  On or before 12/12/17, the employer did not provide training to each employee to enable employees to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.  Employees were performing siding work on the roof of a two  story residential building without adequate fall protection training.  An employee sustained serious injuries when he fell approximately 19.5 feet from the roof to the sidewalk.  This condition exposed employees to fall hazards of approximately 19.5 feet.

29 CFR 1910.1200(e)(1):  The employer did not develop, implement, and maintain a written hazard communication program which at least described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also included a hazardous chemicals list and methods used to inform employees of the hazards of non-routine tasks:  a) SK Construction Inc. at 3060 West 29th Avenue Boulder, CO 80301:  On and before 12-12-17, the employer did not develop, implement, and maintain a written hazard communication program which at least described how to properly read and comprehend chemical labels and other forms of warning and safety data sheets.  The employer used certain chemicals on site, such as, but not limited to, paint and caulk.  The employer has not established a written hazard communication program to address these chemicals.  Abatement note:  The requirements applicable to construction work under 29 CFR 1926.59 are identical to those set forth at 1910.1200 of this chapter.

These chemicals included caulking and paint. This condition exposed employees to chemical irritations to eyes, respiratory, and skin due to employee lack of knowledge regarding chemical hazards.  Abatement note:  Note: The requirements applicable to construction work under 29 CFR 1926.59 are identical to those set forth at 1910.1200 of this chapter.

Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals.  Chemical-specific information must always be available through labels and safety data sheets:  a) SK Construction Inc. at 3060 West 29th Avenue Boulder, CO 80301: On or before December 12, 2017, the employer did not provide information and training to employees on the chemicals used at this worksite and on safety data sheets.  Employees use chemicals such as caulking and paint on a daily basis. This condition exposes employees to chemical irritations to eyes, respiratory, and skin due to employee lack of knowledge regarding chemical hazards.
