29 CFR 1926.502(d)(15): Anchorage used for attachment for personal fall arrest equipment was not capable of supporting at least 5,000 pounds (22.2 kN) per employee attached nor was it designed, installed and used as follows: As part of a complete personal fall arrest system which maintains a safety factor of at least two; and under the supervision of a qualified person.  (a) New residential construction located on Lot #26, Roof: On or about 12/21/2017, and at times prior, the employer exposed employees to falls of approximately 28-feet, 3-inches from a 12/14 pitched roof, in that two roofers were attached to the same temper anchor located on the hip ridge of the roof. The anchor used on the roof was not properly installed and two personal fall arrest systems cannot be attached to this type of anchor point.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) New residential construction located on Lot #26, Rear corner: On or about 12/21/2017, and at times prior, the employer exposed employees to fall hazards of approximately 15-feet, in that the ladder used to access the roof was not extended at least 3-feet or secured to the structure to allow for safe access on and off the roof.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a) New residential construction located on Lot #26, Roof: On or about 12/21/2017, and at times prior, the employer exposed employees to fall hazards of 28-feet, 3-inches on a 12/14 pitched roof, in that a fall protection system was not provided to an employee engaged in slate roofing installation on a steep roof.   Martin Gonzalez, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1212832, citation number 1, item number 2 and was affirmed as a final order on 03/31/2017, with respect to a workplace located at Lot #33 Grand Crescent, Alpharetta, GA 30009.
