(i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: a) Resource Recovery Plant - On or about January 9, 2018, and at times prior and since, the employer failed to ensure that employees engaged in servicing of equipment (unclogging) were protected from falls of approximately six (6) feet. Employees climb on top of the equipment to unclog a screw auger which feeds a hammer mill exposing them to fall hazards.

29 CFR 1910.147(d)(2): The machine or equipment was not turned off or shut down using the procedures established for the machine or equipment: a) Resource Recovery Plant - On or about January 9, 2018, and at times prior and since, the employer failed to ensure an orderly and safe shut down of equipment prior to servicing or maintenance (unjamming) of the screw auger which feeds the Hammer Mill. As a result, remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], and verification of isolation [(d)(6)], were not implemented to safeguard employees from the machine servicing hazards. Employees clearing jams in the auger are exposed to amputation hazards created by the unexpected start up or re-energization of the auger.

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed: a) Resource Recovery Plant - On or about January 9, 2018, and at times prior and since, the employer failed to ensure that a periodic inspection of energy control procedures, to include the Press/Crax Area Motors (M-400 through M-485) were conducted at least annually. Abatement Note: * Where lockout is used for energy control, the periodic inspection shall include a review, between the inspector and each authorized employee, of that employee's responsibilities under the energy control procedure being inspected.1910.147(c)(6)(i)(D) * Where tagout is used for energy control, the periodic inspection shall include a review, between the inspector and each authorized and affected employee, of that employee's responsibilities under the energy control procedure being inspected, and the elements set forth in paragraph (c)(7)(ii) of this section.1910.147(c)(6)(ii) * The employer shall certify that the periodic inspections have been performed. The certification shall identify the machine or equipment on which the energy control procedure was being utilized, the date of the inspection, the employees included in the inspection, and the person performing the inspection.
