29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    On or about January 5, 2018, employees were exposed to struck-by and fall hazards when employees had not been trained or training was inadequate for the following trench hazards:  a. employees did not know that a ladder or other means was required to provide safe egress from a trench that was four or more feet deep.  There was no ladder in the 75" deep trench.  b. employees did not know that a trench box or other means to prevent cave-in was required in trenches greater than five feet or in shallower trenches when there is a hazard such as heavy traffic near the trench.  Employees said that a trench box was required at a depth of six feet.  c.  employees were not instructed to inspect trenches prior to entry for hazards such as, but not limited to, the hazards described above.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    On or about January 5, 2018, an employee was exposed to struck-by and fall hazards when there was no ladder or appropriate ramp to provide egress to the employee who entered the 75" deep sewer pipe trench.    No abatement certification or documentation is required for this item.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:    On or about January 5, 2018, employees were exposed to struck-by hazards when 75 inch deep trench had not been inspected by a competent person who could recognize that a cave-in protective system would have been required for a trench deeper than five feet.    No abatement certification or documentation is required for this item.
