29 CFR 1910.28(b)(11)(ii): Each flight of stairs having at least 3 treads and at least 4 risers was not equipped with stair rail systems and handrails in accordance with Table D-2, Stairway Handrail Requirements:  A.  On or about January 9, 2018, Cold Storage Warehouse:  1.  Power Equipment Side:  The 11-riser stairs  to the storage mezzanine was not provided with a stair rail system on the open right side ascending.    2.  Lawn and Garden Side:  The 11-riser stairs to the storage mezzanine not provided with a star rail system on the left side ascending.  The right side of the stairs was enclosed, the left side had a handrail with no intermediate rail, leaving an opening of greater than 18 inches through which employees could fall to the concrete floor below.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    A.  On or about January 9, 2018, Facility-Wide:  The employer had not developed a hazard communication program which discussed chemical container labeling and other forms of warning, updated safety data sheets, and employee training.   Employees  worked with battery acid, brake cleaner, propane, aerosol silicone, and paints.  Chemicals to which employees were exposed included, but were not limited to, propane, acetone, naphtha, xylene, ethyl benzene, heptane, and tolene.  Exposure to these chemicals can cause thermal burns, frostbite, skin irritation, eye irritation, allergic skin reaction, cancer, suspected of damaging fertility or the unborn child, drowsiness or dizziness, damage to organs and may be fatal if swallowed and enters the airways.
