29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a. The employer fails to assure effective protection against falls as required by the standard, as demonstrated on January 10, 2018, when two employees are working on a 6:12 steep slope, residential roof at 2567 Star Coral Lane, New Smyrna Beach, FL without fall protection and were exposed to falls of approximately 9 feet to the ground below.     Next Generation Roofing Contractors, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1273659, opened on October 24, 2017, citation number 1, item number 1 and has not been affirmed as a final order yet, with respect to a workplace located at 506 Silver Square Lane, Lot 69, Ormond Beach, FL 32174.    Next Generation Roofing Contractors, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1242930, citation number 1, item number 1 and was affirmed as a final order on November 29, 2017, with respect to the workplace located at 4 Walnut Place, Palm Coast, FL 32164.     Next Generation Roofing Contractors, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(11), which was contained in OSHA inspection number 1219127, citation number 1, item number 1 and was affirmed as a final order on June 20, 2017, with respect to a workplace located at 1101 N. Wymore Road, Maitland, FL 33805.

29 CFR 1926.502(k)(1): The fall protection plan shall be prepared by a qualified person and developed specifically for the site where the leading edge work, precast concrete work, or residential construction work is being performed and the plan must be maintained up to date.    a. On or about January 10, 2018 the employer did not prepare, maintain or provide a written fall protection plan to employees engaged in residential new roof installations, to demonstrate that it is infeasible or it creates a greater hazard to use conventional fall protection equipment.

On or about January 10, 2018 two employees, working in the rain, on a 6:12 pitch steep slope roof, installing new roof shingles were not protected by any means of fall protection. The employer did not maintain or provide a written certification of training of the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.
