29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes: (a) Comex Construction Inc., at 372 Main Street, Deadwood, SD 57732: On and before January 2, 2018, the exposing employer did not ensure employees were protected from falls from the fourth to third floor, in that employees were accessing the fourth floor through a floor hole with no protective system in place. Employees worked in the area near the floor hole. This condition exposed employees to a fall hazard of approximately 10 feet.

29 CFR 1926.1053(b)(13): The top or step of a stepladder shall not be used as a step: (a)Comex Construction Inc., at 372 Main Street, Deadwood, SD 57732: On and before January 2, 2018, the exposing employer did not ensure employees were protected from falls in that they were utilizing an eight foot step ladder to gain access through a floor hole to the fourth floor, requiring employees to use the top step of the step ladder. This condition exposed employees to a nine foot eight inch fall hazard.
