29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached) where the outside bottom edge of the wall opening is 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 m) above the walking/working surface, was not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system: (a)Comex Construction, Inc. at 825 Eglin Street, Rapid City, SD 57003: On or about and at times prior to August 16, 2018, the exposing employer did not ensure that employees were protected from falls from a third story balcony wall opening by guardrail systems, safety net systems, or personal fall arrest systems. During the process of installing guardrails, an employee was standing in the wall opening exposed to a fall hazard. This condition exposed an employee to a 30-foot fall hazard.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a)Comex Construction, Inc. at 825 Eglin Street, Rapid City, SD 57003: On or about and at times prior to August 16, 2018, the exposing employer did not ensure that employees were trained to recognize hazards associated with falls. An employee that was working on installing guardrails without the use of a fall protection system had not received fall protection training. The condition exposed an employee to a fall hazards of approximately 30 feet.

29 CFR 1926.1052(c)(1)(i): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail: (a)Comex Construction, Inc. at 825 Eglin Street, Rapid City, SD 57003: On or about and at times prior to August 16, 2018, the exposing employer did not ensure that the stairways leading from the main floor to the second, third, and fourth floors were not equipped with a handrail. The stairway had approximately 10 risers to each landing. This condition exposed employees to fall hazards while using the stairs to gain access to the building.
