29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (a) Production Area- On or about January 11, 2018, and at times prior, the employer exposed employees to noise hazards, in that the employer failed to implement a hearing conservation program for employees exposed to noise levels above the Action Level of 85 dBA while operating the edger and chipper machines. An employee operating the edger machine was exposed to continuous noise at 76.24 % of the permissible daily exposure of 85 dBA (time weighted average) or an equivalent sound level of 88.0 dBA during the 427 minute sampling period on January 11, 2018. The exposure calculation included a zero increment for the 53 minutes not sampled. An employee operating the edger machine was exposed to continuous noise at 111.1 % of the permissible daily exposure of 85 dBA (time weighted average) or an equivalent sound level of 90.7 dBA during the 417 minute sampling period on January 11, 2018. The exposure calculation included a zero increment for the 63 minutes not sampled. An employee feeding the chipper machine was exposed to continuous noise at 148.7 % of the permissible daily exposure of 85 dBA (time weighted average) or an equivalent sound level of 92.8 dBA during the 396 minute sampling period on January 11, 2018. The exposure calculation included a zero increment for the 84 minutes not sampled.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (a) Wood Mold/Iron Stain Inhibitor area- On or about January 11, 2018, and at times prior, the employer exposed an employee to a health hazard, in that the employer failed to establish a written hazard communication program for an employee exposed to hazardous substances such as, but not limited to, NeXgen, mold fungicide, containing methylene bis-thiocyanate and NeX-Brite, Iron Stain Inhibitor containing, 1-Hydroxyethylidene 1,1- diphosphonic acid.
