29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. On or about January 11, 2018, employees were exposed to a struck by hazard. The employees were performing framing activities on a new residential home located on SL 7b Old Mill Road, Cuyahoga Falls, Ohio 44223. The employees were using air powered nail guns without wearing protective safety glasses.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b). On or about January 11, 2018, employees were exposed to a fall of approximately 21 feet. The employees were performing framing activities on a new residential home located on SL 7b Old Mill Road, Cuyahoga Falls, Ohio 44223. There were two employees working on the roof without using any form of fall protection. B&R Construction & Building, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.501(b)(13), which was contained in OSHA inspection number 1216160 citation number 1, item number 1 and was affirmed as a final order on 4/13/2017, with respect to a workplace located at 742 Danbury, Aurora, Ohio 44202.
