29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (Construction Reference 1926.103)  (a) On or about 09/20/2017, at the site, for the employees performing scrapping and painting operations and were required to use respirators such as a N95 3M VFlex and an elastomeric half-face respirator.  The employer did not provide a medical evaluation for the respirator users.   Note:  The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.

Employees were exposed to lead while manually scrapping lead-containing paint.  Employees were observed wearing street clothes and employer did not provide tyvek or coveralls.
