29 CFR 1910.106(e)(6)(ii): Grounding. Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 °F (37.8 °C), shall not be dispensed into containers unless the nozzle and container are electrically interconnected. Where the metallic floorplate on which the container stands while filling is electrically connected to the fill stem or where the fill stem is bonded to the container during filling operations by means of a bond wire, the provisions of this section shall be deemed to have been complied with.   a.) On or about January 18, 2018, the employer failed to adequately ground and bond containers used for transferring flammable liquids in the production area, exposing employees to hazards from fire and explosion.  Employees were transferring acetone from drums into smaller plastic containers to be used in spray painting activities.

There shall be no open flame or spark producing equipment in any spraying area nor within 20 feet thereof, unless separated by a partition.   a) On or about January 18, 2018 The employer failed to ensure that there was no spark producing equipment within 20 feet of the spraying area.  Employees are spraying paint in the shop area; electrical outlets and uncovered lights were in the spray area.  They were not designed for use in a Class I Division II hazardous location.

On or about January 18, 2018 the employer did not provide adequate mechanical ventilation to remove flammable vapors and mists from the spray paint operation in the spray area.  Employees were spraying in the open shop area with no mechanical ventilation.

Overspray was visible on the walls, floor and electrical outlets in the spray area. Employees were exposed to fire hazards from the potential ignition of the combustible material.
