29 CFR 1926.102(a)(1): Employees were not provided with eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents: New townhome construction located on Lots #1-6, Roof: On or about 01/16/2018, and at times prior, the employer exposed employees to struck-by hazards while operating pneumatic framing nail guns at 120 PSI, in that protective eyewear was not provided to employees engaged in plywood sheathing installation. Fidel Rivera was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1050091, citation number 1, item number 2 and was affirmed as a final order on 10/02/2015, with respect to a workplace located at 4110 Cameron Court, Cumming, GA 30040.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) New townhome construction located on Lots #1-6, Rear roof: On or about 01/16/2018, and at times prior, the employer exposed employees to fall hazards of 21-feet, 7-inches on a 6/12 pitched roof, in that a fall protection system was not provided to employees engaged in plywood sheathing installation. (b) New townhome construction located on Lots #1-6, Front roof: On or about 01/16/2018, and at times prior, the employer exposed employees to fall hazards of 21-feet, 11-inches on a 6/12 pitched roof, in that a fall protection system was not provided to employees engaged in plywood sheathing installation. (c) New townhome construction located on Lots #1-6, Second level top plate: On or about 01/16/2018, and at times prior, the employer exposed employees to fall hazards of 21-feet, 11-inches while working from the top plate, in that a fall protection system was not provided to employees installing plywood sheathing. Fidel Rivera was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1050091, citation number 1, item number 3 and was affirmed as a final order on 10/02/2015, with respect to a workplace located at 4110 Cameron Court, Cumming, GA 30040.
