29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s)  a)	New residential construction Lot 76:  On or about 9/9/2020, and at times prior, employees were exposed to fall and struck-by hazards, in that the employer failed to initiate programs that required frequent and regular inspections of the worksite to ensure framing employees were provided and wore personal protective required to do their tasks safely.

29 CFR 1926.302(b)(5): The manufacturer's safe operating pressure for hoses, pipes, valves, filters, and other fittings shall not be exceeded,  a)	New residential construction Lot 76, roof and lower level:  On or about 9/9/2020, and at times prior, the employer exposed employees to struck-by hazards, in that the employees were allowed to operate a Pneutools Model SN22/83H framing nail gun at 135 PSI while conducting framing activities which is above the required operating pressure of 70-120 PSI.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a)	New residential construction, lot 76, roof:  On or about 9/9/2020, and at times prior, the employer exposed employees to fall hazards of 20 feet 3-1/2 inches to the lower level, in that the employer did not provide fall protection training to employees working on the roof conducting framing activities so that they are able to recognize fall hazards and how to prevent them.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step.  a) New residential construction, Lot 76, Lower level:  On or about 9/9/2020, and at times prior, the employer exposed employees to fall hazards of more than 4 feet to the concrete slab below, in that the employees were utilizing the top step of a Louisville Model FS1504, 4-foot portable step ladder to gain access to work on the outside frame of a residential construction building on the second floor. The second floor was approximately 4 1/2 feet above the top of the ladder.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a)	New residential construction, lot 76, roof and lower levels:  On or about 9/9/2020, and at times prior, the employer exposed employees to struck-by hazards, in that employees working with a pneumatic Pneutools Model SN22/83H framing nail gun @ 135 PSI were not provided with eye protection while operating the nail gun conducting framing activities.     Fidel Antonio Rivera was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1288480, citation number 1, item number 1 and was affirmed as a final order on 3/29/2018 , with respect to a workplace located at 5716 Taylor Way, Sandy Springs, GA.30328.
