29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step. a) New residential construction, Lot 76, Lower level: On or about 9/9/2020, and at times prior, the employer exposed employees to fall hazards of more than 4 feet to the concrete slab below, in that the employees were utilizing the top step of a Louisville Model FS1504, 4-foot portable step ladder to gain access to work on the outside frame of a residential construction building on the second floor. The second floor was approximately 4 1/2 feet above the top of the ladder.
