29 CFR 1960.8(a): 29 CFR 1960.8(a): The Agency head did not furnish employment and a place of employment to each employee that were free from recognized hazards that caused or were likely to cause death or serious physical harm: a) Norfolk Naval Shipyard, Portsmouth, VA 23709: On or about January 23, 2018, and times prior thereto, employees were exposed to struck-by hazards when tasked with delivery of materials, including but not limited to, lengths of pipe, that were not secured from side-shifting in transit or for off-loading, to include delivery following partial off-load of materials. Among other methods, feasible and acceptable methods to correct this hazard are: 1. Follow the Federal Motor Carrier and Safety Administration Regulations, 49 CFR 393.106 for securing cargo. a. Cargo must be firmly immobilized or secured on or within a vehicle by structures of adequate strength, dunnage or dunnage bags, shoring bars, tie-downs or a combination of these. b. Cargo that is likely to roll must be restrained by chocks, wedges, a cradle or other equivalent means to prevent rolling. The means of preventing rolling must not be capable of becoming unintentionally unfastened or loose while the vehicle is in transit. c. Tie-downs must be of adequate strength to secure the load. 2. Develop and implement specific procedures for loading and off-loading flatbed trailers and trucks, to include partial off-load of materials.

29 CFR 1904.41(a)(2): Annual electronic submission of OSHA Form 300A Summary of Work-Related Injuries and Illnesses by establishments with 20 or more employees but fewer than 250 employees in designated industries. The establishment had 20 or more employees but fewer than 250 employees at some time during the previous calendar year, and the establishment was classified in an industry listed in appendix A to subpart E of this part, but did not electronically submit information from OSHA Form 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee. The employer did not submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the form: a) Norfolk Naval Shipyard, Building 276, Portsmouth, VA 23709: On or about January 25, 2018, and times prior thereto, the employer failed during calendar year 2017, to electronically submit information from the OSHA Form 300A or equivalent by December 15, 2017. The establishment employed approximately 128 employees and was classified in 493110 during calendar year 2016. No abatement documentation or certification is required.
