29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or about January 24, 2018, at the site located at 7247 Monarch Street, Canal Winchester, Ohio, the employer failed to maintain a safety and health program to ensure hazard detection and correction.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.   a.  On or about January 24, 2018, at the site located at 7247 Monarch Street, Canal Winchester, Ohio, employees were installing siding on a two story residential home from a pump jack scaffold without the use of fall protection, thereby exposing the employee to a fall hazard of 12 feet.

29 CFR 1926.454(c): When the employer has reason to believe that an employee lacks the skill or understanding needed for safe work involving the erection, use or dismantling of scaffolds, the employer shall retrain each such employee so that the requisite proficiency is regained.  a. On or about January 24, 2018, at the site located at 7247 Monarch Street, Canal Winchester, Ohio, the employer failed to provide retraining to an employee that demonstrated a lack of proficiency in safe scaffold use.
