29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder was not secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, was not provided to assist employees in mounting and dismounting the ladder: location: exterior building between ground and 2nd floor on or about: 12/21/17 a) Employees were using an job made wooden ladder to access the 2nd floor. The ladder only extended above the upper level approximately 1 foot. NOTE: Because abatement of this violation is already documented in the inspection casefile, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: location: 2nd floor on or about: 12/21/17 a) Employees were engaged in carpentry work, 11 feet above the ground. The employees were not protected from falling to the ground and floor below. NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19. The Upstate Framing Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 960943, citation number 1, item number 5 and was affirmed as a final order on 5/14/2014, with respect to a workplace located at 115 Winterton Road, Bloomingburg, NY 12721.
