29 CFR 1910.178(a)(4): Modifications and additions which affected capacity and safe operation were performed by the customer or user without manufacturers written approval, and the capacity, operation and maintenance instruction plates, tags or decals were not changed accordingly: Employees engaged in material handling activities were exposed to struck-by and crushing hazards in that the employer modified the forks with an attachment without written approval by the manufacturer and did not change information accordingly.

The employees were exposed in that the following forklifts were found in need of repair: a) Toyota (Model-5FBCHU25, SN-60340) had an inoperable horn and damaged tires b) Yale (VIN: SLP930025E0824710) was missing directional markings c) Ingersoll Rand (Model-RT706G, SN-140253) was missing directional markings and damaged/torn seat
