29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems. a. On January 31, 2018, four employees were not protected by conventional fall protection methods while engaged in roofing activities on a new construction, single family residence with an 8/12 pitch roof located at 2846 Villa Way Menasha, WI 54953. The employees were exposed to falls of approximately ten feet and were not utilizing a complete Personal Fall Protection System.

29 CFR 1926.502(d)(21): Personal fall arrest systems shall be inspected prior to each use for wear, damage and other deterioration, and defective components shall be removed from service. a. On January 31, 2018, an employee was wearing a damaged harness as part of his personal fall arrest system while installing shingles on a new residential construction with an eave height of approximately ten (10) feet located at 2846 Villa Way Menasha, WI 54953. The harness had a worn strap on the back of the Left leg and could have failed as a component of their Personal Fall Arrest System when used to prevent a fall to the lower level.
