29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems. a. On or before January 22, 2018 where an employee was framing a dormer around the chimney, the employee was not protected from falls, resulting in the employee falling 30 feet which required the employee to be hospitalized due to the subsequent injuries. b. On or before January 30, 2018 where employees were framing and sheathing the exterior of the house, the employees were not protected from falls, thereby being exposed to fall hazards of up to 30 feet. c. On or before January 30, 2018 where employees were working on the porch of the house, the employees were not protected from falls, thereby exposing the employees of falls of 8 feet, 2 inches.

29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. a. On or before January 22, 2017, where an employee was hospitalized due to serious injuries sustained as a result of a fall, the employer failed to report the overnight hospitalization of the employee to OSHA within twenty-four (24) hours.
