29 CFR 1910.119(j)(5): The employer did not correct deficiencies in equipment that were outside acceptable limits (defined by the process safety information on paragraph (d) of this section) before use.        a) In the tank farm, on or about 3/6/2018: The employer did not correct deficiencies in accordance with their written mechanical integrity procedures. Cleaning of chipped and flaking old paint and re-painting of pipes had not been conducted during the past two annual pipe inspections. Rust was observed on pipes containing flammable substances during the course of the inspection.        Abatement certification must be submitted for this item.

29 CFR 1910.120(q)(2)(xi): The emergency response plan did not address, to the extent not addressed elsewhere,  personal protective equipment and emergency equipment:   a) In the alcohol batching department, on or about 3/1/18: The employers emergency response procedures for employees who were expected to investigate spills or potential spills of ethyl alcohol from the alcohol batching process did not include instructions on how PPE and emergency equipment including but not limited to instruments for assessing atmospheric hazards were to be used, their limitations, and in what situations emergency responders will use them.     Abatement certification must be submitted for this item.

29 CFR 1910.120(q)(6)(i)(C): Employees who participated, or were expected to participate, in emergency response as first responders at the awareness level did not have sufficient training or sufficient experience to objectively demonstrate competency in the ability to recognize the presence of hazardous substances in an emergency.    a) In the Alcohol batching department, on or about 3/1/18: Employees who were expected to investigate spills or potential spills of ethyl alcohol from the alcohol batching process did not have sufficient training or experience to demonstrate competency in the ability to recognize the presence of hazardous substances. Employees did not recognize how to evaluate the airborne concentration of flammable substances when responding to an incident. When responding to conditions that trigger the area LEL alarm system, the employees were not trained to evaluate the airborne concentration of flammable substances to know how much the concentration exceeded the alarm set points.    Abatement certification must be submitted for this item.
