29 CFR 1910.147(c)(6)(i)(B): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed: On or about February 19, 2018, the employer failed to conduct a periodic inspection of their hazardous energy control program at least annually. The last audit of their program was in 2014. The employer failed to identify a pneumatic energy source on the M964, L12 Hydraulic Cutoff Machine as part of their energy control lock out tag out procedures.

29 CFR 1910.147(d)(6): Prior to starting work on machines or equipment that had been locked out or tagged out, the authorized employee did not verify that isolation and de-energization of the machine or equipment had been accomplished: On or about February 19, 2018, the employer failed to ensure that verification that all possible energy sources on the M964, L12 Hydraulic Cutoff Machine were locked out prior to allowing employees to perform a die change out on the machine. The pneumatic energy source was not locked out at the time of the die change out.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about February 19, 2018, the employer failed to ensure the M964, L12 Hydraulic Cutoff Machine was effectively guarded. The employer was using various accordion style gates, that are portable and not secured in place, to block off certain parts of this machine. There were work tools, rags and supplies on the other side of the gates that were lying on or near the machinery. NOTE: The employer was previously cited for a violation of this occupational safety and health standard or it's equivalent standard which was contained in OSHA Inspection #1043604, citation 1, item 1, which was affirmed as final order on July 6, 2016, with respect to the workplace located at 5535 Wegman road, Valley City OH 44280.
