29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact. At a jobsite located at the intersection of 75th Street and Wornall Road, Kansas City, Missouri, an employee was exposed to serious struck by and respiratory hazards in that the employee was saw-cutting a section of the road without utilizing face and respiratory protection.

General-duty citation text
29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. At a jobsite located at the intersection of 75th Street and Wornall Road, Kansas City, Missouri, an employee was exposed to serious respiratory hazards in that the employee was saw-cutting a section of the road without utilizing the engineering controls, work practices, and respiratory protection specified for the task on Table 1.
