29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)    a)  Worksite, north side of building - The employee was exposed to falling approximately 14 feet to the ground below. The scaffold had three planks installed; on or about 2/14/18.    b)  Worksite, west side of building - The employee was exposed to falling approximately 16 feet to the ground below.  The scaffold had two planks installed; on or about 2/14/18.    Note: Because the abatement of this violation is already documented in the case file, the employer need not submit certification of documentation of abatement for this violation as normally required by CFR 1903.19

29 CFR 1926.451(e)(1):   When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Cross braces were used as a means of access.    a)  Worksite, north side of building - The employees were accessing the second level of the fabricated frame scaffold by climbing on the end frames and cross bracing, exposing themselves to falls of approximately 14 feet to the ground below; on or about 2/14/18.    Note:  Because abatement of this violation is already documented in the case file, the employer need not submit certification of documentation of abatement for this violation as normally required by CFR 1903.19

29 CFR 1926.451(g)(4)(xv): Crossbracing used in place of both a toprail and midrail was unacceptable. When the crossing point of two braces is between 38 inches (0.97 m) and 48 inches (1.3 m) above the work platform, this may be concentered as a toprail only. A midrail is required.     a)  Worksite, north side of building - The employees were observed working from the second tier of a fabricated frame scaffold, with only a crossbrace used in lieu of a toprail. A midrail was missing, exposing themselves to a fall of approximately 14 feet to the ground below on or about 2/14/18.     Note:  Because abatement of this violation is already documented in the case file, the employer need not submit certification of documentation of abatement for this violation as normally required by 29 CFR 1903.19.
