29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    Employees were not protected by a protective helmet while working underneath and/or around a tubular welded frame scaffolds. The employees were exposed to being struck-by objects and/or tolls falling from a height greater than (40) feet.

29 CFR 1926.451(h)(1): Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects.  For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall.  Employees performing stucco activities below employees performing stucco installation activities above on scaffolds were not protected from struck-by hazards by hard hats and toe boards. Employees were exposed to struck-by hazards up to (40) feet.

29 CFR 1926.451(c)(2)(v): The employer used forklifts  to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied:    At a commercial construction worksite, the employer did not ensure a scaffold work platform was attached to the forks of a JLG SKYTRAK 10054 rough terrain fork lift truck.  Employees working from the elevated platform were exposed to a fall of up to (40) feet to the ground below.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.  At a commercial construction jobsite, an employee applying stucco from a field designed personnel platform that was elevated by a JLG SKYTRAK, Model 10054 rough-terrain-forklift, was left attended by the operator exposing the employee to a fall hazard of approximately (40) feet to the ground below.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms without being specifically designed by the manufacturer for such use: (General Industry Reference 1910.27(a))    At a commercial construction jobsite, a stucco employee was working from a field designed personnel platform that was not approved by the manufacturer for construction, capacity, use, and fall protection. The employee was exposed to a fall hazard of approximately (40) feet to the ground below.     Jorge Arturo Rocha was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(c)(2)(iv), which was contained in OSHA inspection number 1002465, citation number 1, item number 1 and was affirmed as a final order on 12/18/2014 with a final abatement date of 01/25/2015 , with respect to a workplace located at 420 Centre Port Blvd, Fort Worth, Texas.
