29 CFR 1926.503(c)(3): The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section. On or about February 14, 2018, employees were working on a residential home without having adequate understanding and skill in using fall protection equipment. This condition exposed employees to fall hazards greater than six feet.

29 CFR 1926.501(b)(13): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems. On or about February 14, 2018, employees were working on a residential home without using any form of fall protection. Employees were exposed to fall hazards of more than six feet to the ground below. Rodolfo Perez was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1133454 citation number 1, item number 1 and was affirmed as a final order on 06/16/2016, with respect to a workplace located at 7864 Enchanted Range Dr., El Paso, TX 79911. Rodolfo Perez was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 945271 citation number 1, item number 2a and was affirmed as a final order on 11/26/2013, with respect to a workplace located at 172 Old Paint Dr., El Paso, TX 79911.
