On or about 02/15/2018 and at times after, in Area 320 of the CITGO Refinery in Lake Charles, the employer did not implement its management of change process when it deviated from its incident investigation and near miss/deficiencies observed in Area 320 on February 15, 2018 with the following instances: a. Non-functional instrument air gages on the Light Naphtha valve (LV052) was not investigated and tracked in the employers incident tracking system (IMPACT). b. Broken Eaton, pump switch on the Fractionator Reboiler Pump (JP8) was not investigated and tracked in the employers incident tracking system (IMPACT). c. Open ended pipe on the seal pump system for the debutanizer reboiler pump (JP6A) was not investigated and tracked in the employers incident tracking system (IMPACT). d. Open ended pipe found above the Depentanizer reboiler (C108) associated with instrument number 320LSL083 was not investigated and tracked in the employers incident tracking system (IMPACT)

29 CFR 1910.157(e)(1): The employer shall be responsible for the inspection, maintenance and testing of all portable fire extinguishers in the workplace: On or about 02/15/2018, at 4401 LA Hwy-108, Sulphur, LA, employees were working in the Unicracker unit area designated as a Class I, Division 2 location of the facility where light naphtha flammable liquid mixtures are handled, processed or used, and confined within a closed system from which the mixture could escape in the event of accidental rupture or breakdown of such systems resulting in a fire or explosion from an ignition source, and a portable fire extinguisher had not been inspected monthly in the area.
