OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees working at or near dry dust collection systems (indoor enclosureless bag separator and upstream ducting) handling combustible wood dust were exposed to wood dust fire hazards during the operation and maintenance of the dust collection system:    On or about February 21, 2018,    a)  An indoor enclosureless bag separator (Extrema DC-240.3 Portable Dust Collector) with positive pressure air-material inlet and two unenclosed dust filter bags was used to collected combustible wood dust fines from an Extrema wide belt sander. Employees were exposed to the hazards of fire and flash fire from working in close proximity to the indoor enclosureless dust collector and upstream ducting and manually emptying the bags of collected combustible wood dust in the event of the presence of an internal fire, ember or spark.

29 CFR 1910.106(d)(4)(i):  "Construction." Inside storage rooms shall be constructed to meet the required fire-resistive rating for their use. Such construction shall comply with the test specifications set forth in Standard Methods of Fire Tests of Building Construction and Materials, NFPA 251-1969. Where an automatic sprinkler system is provided, the system shall be designed and installed in an acceptable manner. Openings to other rooms or buildings shall be provided with noncombustible liquid-tight raised sills or ramps at least 4 inches in height, or the floor in the storage area shall be at least 4 inches below the surrounding floor. Openings shall be provided with approved self-closing fire doors. The room shall be liquid-tight where the walls join the floor. A permissible alternate to the sill or ramp is an open-grated trench inside of the room which drains to a safe location. Where other portions of the building or other properties are exposed, windows shall be protected as set forth in the Standard for Fire Doors and Windows, NFPA No. 80-1968, which is incorporated by reference as specified in Sec. 1910.6, for Class E or F openings. Wood at least 1 inch nominal thickness may be used for shelving, racks, dunnage, scuffboards, floor overlay, and similar installations:    On or about February 21, 2018, the construction of the inside storage room used to store flammable containers of paints and stains was insufficient when:      a)  The opening to the spray booth room was not protected with 4 inch noncombustible liquid-tight raised sills, ramps or other lowered floor.    b)  The opening between the inside storage room and the spray booth room was not provided with an approved self-closing fire door.    c)  The inside storage room was not liquid-tight where the walls joined the floor.

29 CFR 1910.106(d)(4)(iv):  Ventilation. Every inside storage room shall be provided with either a gravity or a mechanical exhaust ventilation system. Such system shall be designed to provide for a complete change of air within the room at least six times per hour. If a mechanical exhaust system is used, it shall be controlled by a switch located outside of the door. The ventilating equipment and any lighting fixtures shall be operated by the same switch. A pilot light shall be installed adjacent to the switch if Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 °F (37.8 °C), are dispensed within the room. Where gravity ventilation is provided, the fresh air intake, as well as the exhaust outlet from the room, shall be on the exterior of the building in which the room is located:  On or about February 21, 2018, the inside storage room was not provide with either a gravity or mechanical exhaust ventilation system.

This paragraph requires the employer to develop and implement a written respiratory protection program with required worksite-specific procedures and elements for required respirator use. The program must be administered by a suitably trained program administrator. In addition, certain program elements may be required for voluntary use to prevent potential hazards associated with the use of the respirator:    On or about February 21, 2018, the employer did not develop and implement a written respiratory protection program when a Spray Room employee was required to wear a 3M tight-fitting half-face respirator with organic filter cartridges during spray finishing operations to protect against gasses and vapors from wood paints and stains.    All provisions of 29 CFR 1910.134(c) through (m) must be covered in a written respiratory protection program. 29 CFR 1910.134(g)(1)(i)(A): The employer shall not permit respirators with tight-fitting facepieces to be worn by employees who have facial hair that comes between the sealing surface of the facepiece and the face or that interferes with valve function:    On or about February 21, 2018 the employer permitted a Spray Room employee to wear a 3M tight-fitting half-face respirator when the employee had facial hair that came between the sealing surface of the facepiece of the respirator. The respirator was worn during spray finishing operations to protect against gasses and vapors from wood paints and stains.

29 CFR 1910.134(k):  Training and information. This paragraph requires the employer to provide effective training to employees who are required to use respirators. The training must be comprehensive, understandable, and recur annually, and more often if necessary. This paragraph also requires the employer to provide the basic information on respirators in Appendix D of this section to employees who wear respirators when not required by this section or by the employer to do so:    On or about February 21, 2018, the employer did not provide effective training to a Spray Room employee who was required to wear a 3M tight-fitting half-face respirator. The respirator was worn during spray finishing operations to protect against gasses and vapors from wood paints and stains.    All provisions of the training paragraph 29 CFR 1910.95(k) must be provided to affected employees.
