29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:      a) On or about 2/19/18 on a jobsite at the Residence Inn Construction Site, 620 Delaware Avenue, Buffalo, NY:  Employees engaged in electrical work were not trained to recognize potential electrical and arc flash hazards on this type of jobsite, and protective measures such as but not limited to the use of lockout/tagout procedures, use of insulated tools, and the need for personal protective equipment to protect them from various electrical hazards. They also were not trained in the applicable OSHA regulations to control or eliminate these hazards.      ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.417(b): Equipment or circuits that were deenergized were not rendered inoperative and did not have tags attached at all points where such equipment or circuits could be energized:      a) On or about 2/19/18 in the transformer vault room on a jobsite at the Residence Inn Construction Site, 620 Delaware Avenue, Buffalo, NY:  Employees were in the process of removing old electrical conduits and the wires inside them.  An employee was using a pair of Klein Journeyman Heavy Duty Side Cutting Pliers (not insulated ) to cut out wires that had previously been inside a conduit and were deenergized.  After the lunch break, at least one of the wires had become energized and the employee suffered severe burns when he began cutting it. The circuits that were deenergized were not rendered inoperative and did not have tags attached at all points where such equipment or circuits could be energized.     b) On or about 2/19/18 in the transformer vault room on a jobsite at the Residence Inn Construction Site, 620 Delaware Avenue, Buffalo, NY:  Employees were in the process of removing old electrical conduits and the wires inside them.  An employee was in a one-person lift using a sawzall to cut the metal conduits. The circuits that were deenergized inside the conduit  being cut were not rendered inoperative and did not have tags attached at all points where such equipment or circuits could be energized.      NO ABATEMENT DOCUMENTATION REQUIRED

29 CFR 1904.39(a)(2): The employer failed to report the in-patient hospitalization of one or more employees as a result of a work-related incident, within (24) twenty-four hours.      a) On 2/19/18 on a jobsite at the Residence Inn Construction Site, 620 Delaware Avenue, Buffalo, NY: An employee cut into an energized 120 volt-ac conductor, suffered serious injuries and was hospitalized. The employer did not notify OSHA within 24 hours of a work related incident that resulted in an in-patient hospitalization.         NO ABATEMENT CERTIFICATION REQUIRED
