29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 paragraph (b) or (c) of this section. a) 109 Long Street, Mobile AL; On or about March 1, 2018 the controlling employer, Harvill, Inc., failed to ensure that its sub-contractor, Ken Nichols, Inc., protected its employees from cave-in hazards in that employees were allowed to work inside of an excavation at the base of an 8 foot dirt wall in class "b" soil. Employees were not protected from cave-ins by an adequate protective system and the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (thirty-four degrees measured to the horizontal).
