29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. a) Highway 104 East of Higbee Road, Fairhope AL; On or about February 28, 2018 the employer exposed employees to cave-in and struck-by hazards in that employees were required to work inside an 8 foot deep trench that had an 8 foot tall spoil pile located on the edge of the trench which was not retained or otherwise prevented from being able to fall or roll back into the excavation.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 paragraph (b) or (c) of this section. a) Highway 104 East of Higbee Road, Fairhope AL; On or about February 28, 2018 the employer exposed employees to cave-in hazards in that employees were allowed to work inside of a trench measuring eight feet deep, thirteen feet wide, and thirty-five feet in length that was dug in class "b" soil. The employer had not complied with the standard in that employees were not protected from cave-ins by an adequate protective system and the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (thirty-four degrees measured to the horizontal).
