29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provided for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them:    (a)Rutten Structures, Inc. at 47418 US Hwy 18, Canton, SD 57013:  On or about and at times prior to March 2, 2018, the exposing employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Two employees were working on the roof of a pole barn under construction, installing metal roof panels without the use of a fall protection system. The employees were accessing/egressing the roof using a personnel platform connected to a Caterpillar TH63 Telehandler that did not meet ASME/ITDSF criteria related to dimensional size of the platform and did not have guardrails installed. The conditions exposed employees to fall hazards of approximately 14 feet.

29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person and shall be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section:        (a)Rutten Structures, Inc. at 47418 US Hwy 18, Canton, SD 57013: On or about and at times prior to March 2, 2018, the exposing employer did not ensure that the supported scaffold was designed by a qualified person in that, the scaffold platform was constructed by non qualified personnel. A rough terrain fork-lift was used to elevate employees approximately 14 feet on a platform in order to install metal roof panels. The CAT TH63 Telehandler Handbook stated to to use only a CAT manufactured personnel work platforms. This condition exposed the employee  to a fall hazard of approximately 14 feet.                                                          OR IN THE ALTERNATIVE     29 CFR 1926.451(c)(2)(iv):  Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use:     (a)Rutten Structures, Inc. at 47418 US Hwy 18, Canton, SD 57013: On or about and at times prior to March 2, 2018, the exposing employer did not ensure employees were protected from serious injury by the use of an elevated work platform which was not designed, constructed, or used in accordance with the requirements of the manufacturer. The employer utilized the forklift platform in the construction of a pole barn The platform was not specifically designed by the manufacturer to meet ASME/ITSDF B56.6-2011 requirements. The platform exceeded criteria for the overall length, and did not have a data plate identifying maximum working load including personnel and equipment. This condition exposed employees to fall hazards and crushing hazards related to the platform separating from the mast.       Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that all platforms used for elevating personnel with a rough terrain forklift truck comply with the design requirements specified in ASME/ITSDF B56.6-2011, American Society of Mechanical Engineers/Industrial Truck Standards Development Foundation, "Safety Standards for Rough Terrain Forklift Trucks",  Section 8.24.1, Platforms for Elevating Personnel, in the following areas: (1)Paragraph (b) which states, "floor dimensions which shall not exceed two times the load center distance listed on the rough terrain forklift truck nameplate, measured parallel to the longitudinal center plane of the truck, nor have a length greater than the overall width of the truck measured across the load bearing tires plus 10 in. (250 mm) on either side. (2)Paragraph (f) which states, "information prominently indicated on the platform: (1) maximum work load including personnel and equipment; (2) weight of empty platform." 29 CFR 1926.760(a)(1): Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems.     (a)Rutten Structures, Inc. at 47418 US Hwy 18, Canton, SD 57013: On or about and at times prior March 2, 2018, the exposing employer did not ensure that employees installing metal roof panels near the peak of the low slope roof on the pole barn were protected from fall hazards. Two employees were not utilizing a fall protection system while installing the metal roof panels. This condition exposed employees to a fall hazard of 20 feet to the interior and the rake edge of the roof and a 14 feet fall hazard at the eave.
