29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck (except for training purposes).    On or about 5 March 2018, and at times prior thereto, an employee operated a JLG 8042 Rough Terrain Telehandler Forklift at the work site without being fully trained and certified by the company on the equipment, exposing the operator and those nearby to the hazard of being struck by the forklift or the load.

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval.    On or about 5 March 2018, and at times prior thereto, three job-made wooden trash boxes were being used at the work site for construction trash and debris, or for moving materials, without the approval of the manufacturer, exposing the operator and those nearby to the hazard of being struck by the trash box and the contents.  1) A small job-made wooden trash box was being used to move HVAC materials to the second floor of Building 2. The box was observed to be tilted forward at the time, with two workers at the edge of the box.  2) A job-made wooden trash box was being used to remove construction debris from the second story roof of the Main Building.  3) A job-made wooden trash box was attached to a forklift that was parked in the lot of the General Contractor's trailer on site.
