29 CFR 1926.451(f)(7):  Scaffolds were not erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person:       a)  Kuro LTD at 360 Lake Avenue, Aspen, Colorado 81611:  On or before October 30, 2017, the exposing employer did not ensure that the scaffolds were erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration.  The employer used a mobile scaffold to erect steel columns and to install wooden roof beams.  On October 30, 2017, after removing crane hoisting straps from a wooden roof beam, an apprentice carpenter fell approximately 20 ft. from the mobile scaffold onto a vertical concrete barrier below.  This condition exposed this employee to a fall hazard of approximately 20 feet.        Note "competent person" is defined as "one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.451(g)(1):  Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to a lower level:      a) Kuro LTD at 360 Lake Avenue, Aspen, Colorado 81611:  On or before October 30, 2017, the exposing employer did not ensure that each employee working on a scaffolds more than 10 feet above a lower level was protected from falling to a lower level.  The employer used a mobile scaffold to erect steel columns and to install wooden roof beams.  Employees working on this mobile scaffold were not protected from fall hazards in that the mobile scaffold was used with missing guardrails.  On October 30, 2017, after removing crane hoisting straps from a wooden roof beam, an apprentice carpenter fell approximately 20 ft. from the mobile scaffold onto a vertical concrete barrier below.  This condition exposed this employee to a fall hazard of approximately 20 feet.

29 CFR 1926.452(w)(6):  Employees were allowed to ride on scaffolds when the following conditions did not exist:      (i)  The surface on which the scaffold is being moved is within 3 degrees of level, and free of pits, holes, and obstructions;    (ii)  The height to base width ratio of the scaffold during movement is two to one or less, unless the scaffold is designed and constructed to meet or exceed nationally recognized stability test requirements such as those listed in paragraph (x) of Appendix A to this subpart (ANSI/SIA A92.5 and A92.6);    (iii)  Outrigger frames, when used, are installed on both sides of the scaffold;      (iv)  When power systems are used, the propelling force is applied directly to the wheels, and does not produce a speed in excess of 1 foot per second (.3 mps); and      (v)  No employee is on any part of the scaffold which extends outward beyond the wheels, casters, or other supports.    (a) Kuro LTD at 360 Lake Avenue, Aspen, Colorado 81611:  On or before October 30, 2017, the exposing employer allowed employees to ride a mobile scaffold when safe conditions (as stated above) did not exist, in the following instances:    1)  The employer allowed employees to ride the mobile scaffold even though obstructions and floor holes were present; and     2)  The employer allowed employees to ride the mobile scaffold even though the height to base width ratio was greater than two to one, and the scaffold was not designed and constructed to meet or exceed nationally recognized stability test requirements such as those listed in Appendix A to this subpart (ANSI/SIA A92.5 and A92.6).  The scaffold was approximately 20 feet high with a width at the base of 5 feet.       These conditions exposed employees to fall hazards of approximately 20 feet.

29 CFR 1926.454(a):  The employer did not have each employee who performs work while on scaffolds trained by a person qualified in the subject matter to recognize those hazards associated with the type of scaffolds being used and to understand the procedures to control or minimize those hazards:    (a) Kuro LTD at 360 Lake Avenue, Aspen, Colorado 81611:  On or before October 30, 2017,  the exposing employer did not ensure that each employee who performs work while on scaffolds were trained by a person qualified in the subject matter to recognize those hazards associated with the type of scaffolds being used and to understand the procedures to control or minimize those hazards.  The employer allowed employees to use mobile scaffolds without adequate training.  This condition exposed this employee to a fall hazard of approximately 20 feet.      Abatement Note:  The training shall include the following elements at a minimum:      (1)        The nature of any electrical hazards, fall hazards, and falling object hazards in the work area;      (2)        The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used:      (3)        The proper use of the scaffold, and the proper handling of materials on the scaffold;      (4)        The maximum intended load and the load-carrying capacities of the scaffold used; and      (5)        Any other pertinent requirements of this subpart.

29 CFR 1926.501(b)(1):  Each employee on a walking/working surface having an unprotected side or edge which was 6 feet or more above a lower level was not protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system:    a) Kuro LTD at 360 Lake Avenue, Aspen, Colorado 81611:  On or before October 30, 2017, the exposing employer did not ensure that each employee on a walking/working surface having an unprotected side or edge which was 6 feet or more above a lower level was protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system.  The wall foundation/basement opening adjacent to the stairway into the basement was not provided with guardrails systems. This condition exposed the employees to a fall hazard of approximately 8 feet 10 inches to the concrete floor below.

29 CFR 1926.1430(b): The employer did not train each employee assigned as a signal person who did not meet the requirements of 1926.1428(c) in the areas addressed in that paragraph:    a) Kuro LTD at 360 Lake Avenue, Aspen, Colorado 81611:  On or before October 30, 2017, the exposing employer did not train each employee assigned as a signal person who did not meet the requirements of 1926.1428(c).  A signal person was assigned to assist a crane operator with the placement of loads that were not in full view of the crane operator.  This signal person was not trained in the requirements of 1926.1428(c).  This condition exposed employees to a fall hazard of approximately 20 feet.
