1926.754(e)(2)(ii)  Roof and floor holes and openings shall be decked over. Where large size, configuration or other structural design does not allow openings to be decked over (such as elevator shafts, stair wells, etc.) employees shall be protected in accordance with �� 1926.760(a)(1). 29 CFR 1926.20(b)(2):  The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of job-sites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):  (a)	Koru, Ltd at 220 American Lane, Aspen, CO 81611:  On and before April 7, 2021 the controlling employer did not ensure that subcontractor employees were protected from injury, in that in that subcontractor employees installing metal decking on the second level were working adjacent to rebar that was protruding vertically from several locations of the foundation walls.  Protective covers were not placed on the top-end of the exposed rebar.  This condition exposed subcontractor employees to impalement hazards.  (b)	Koru, Ltd at 220 American Lane, Aspen, CO 81611:  On and before April 7, 2021 the controlling employer did not ensure that subcontractor employees were protected from injury in that not every subcontractor employee who worked in a Controlled Decking Zone (CDZ) was trained in the associated hazards.  Three subcontractor employees were installing decking at the leading edge near the exterior the building on the second level when one of the subcontractor employees fell backwards into an unguarded stairway opening and sustained serious injuries.  This condition exposed subcontractor employees to fall hazards of approximately 14.5 feet and 24 feet.  (c)	Koru, Ltd at 220 American Lane, Aspen, CO 81611:  On and before April 7, 2021 the controlling employer did not ensure that subcontractor employees were protected from injury, in that subcontractor employees made final deck attachments while working in a Controlled Decking Zone (CDZ) without the use of a fall protection system.  This condition exposed subcontractor employees to a fall hazards of approximately 14.5 feet and 24 feet.
