29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities were not performed only by experienced and trained employees selected for such work by the competent person. Between the dates of January 17, and March 5, 2018, employees were not provided direction for the proper erection of the cup lock scaffold. Brand Energy Services, LLC employees and Mike Harris Mason Contractor, Inc. employees working from the scaffold were thereby exposed to the hazards associated with a scaffold collapse. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.451(f)(12): Work on or from scaffolds is prohibited during storms or high winds unless a competent person has determined that it is safe for employees to be on the scaffold and those employees are protected by a personal fall arrest system or wind screens. Wind screens shall not be used unless the scaffold is secured against the anticipated wind forces imposed. On or about March 5, 2018, Mike Harris Mason Contractor, Inc. employees were exposed to a scaffold collapse when the cuplock scaffold used during work activities was not designed or erected to withstand the wind forces imposed. The scaffold was wrapped in a wind screen, which the preliminary drawings prohibited. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

1926.452(b)(10): Tube and coupler scaffolds over 125' in height were not designed by a registered professional engineer, and were not constructed and loaded in accordance with such design. Between the dates of January 17, and March 5, 2018, the employer did not ensure a cuplock scaffold that was erected to an elevation of 132'- 2" was constructed and loaded in accordance with the design of a registered professional engineer to comply with design and loading requirements of scaffolds greater than 125' in height. Brand Energy Services, LLC employees and Mike Harris Mason Contractor, Inc. employees working from the scaffold were thereby exposed to the hazards associated with a scaffold collapse. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
