29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii): On or about 3/2/18 at 450 Buford Highway Suwanee, GA a worker was observed exposed to fall hazards which could potentially result in broken bones or death while walking the top plate, installing wall bracing to the internal wall, 9-feet above the floor below without fall protection. The employer also failed to ensure that fall protection training was provided to all of his employees.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: On or about 3/2/18 at 450 Buford Highway Suwanee, GA a worker was observed exposed to fall hazards which could potentially result in broken bones or death while walking the top plate, installing wall bracing to the internal wall, 9-feet above the floor below without fall protection. The employer also failed to develop and implement a satisfactory fall protection plan where no alternative fall protection was provided for the workers. Juan Andres Guillen Baez dba Cowboy Framing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1198244, citation number 1, item number 3 and was affirmed as a final order on 5/3/2017, with respect to a workplace located at 200 Bradley Parkway Cumming, GA 30040.
