29 CFR 1926.25(a): During the course of construction, alteration, or repairs, form or scrap lumber with protruding nails was not kept clear from work areas:   On or about March 6, 2018, employees were accessing the work area of building #5 where scrap lumber with protruding nails were sticking out in and around the access ladder to the second floor, exposing the employees to the hazard of being pierced by stepping on the protruding nails.

29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.  On or about March 6, 2018, employees were walking and working around wall openings on the second and third floors of building #5 without protective railing in place, exposing the employees to fall heights up to approximately 20 feet.

29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.  On or about March 6, 2018, employees were accessing the second and third floor levels of building #5 under construction where ladder openings through the floors were not protected with guard railing, exposing employees to a fall hazard up to approximately 10 feet.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about March 6, 2018, employees were utilizing pneumatic nail guns to install roof trusses on the top of the third story roof of building #5 without eye protection, exposing the employees to the hazard of being struck by flying objects.  The Abel Nieto Mendoza dba Nieto Truss was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1208303, citation number 1, item number 1 and was affirmed as a final order on April 3, 2017, with respect to a workplace located at 2311 Wolf Ranch Parkway Georgetown, TX 78628.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  On or about March 6, 2018, five employees were installing roof trusses on the third story roofs of Buildings 4 & 5 up to approximately 34 feet high without fall protection, exposing the employees to a fall hazard.  The Abel Nieto Mendoza dba Nieto Truss was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1208303, citation number 1, item number 2 and was affirmed as a final order on April 3, 2017, with respect to a workplace located at 2311 Wolf Ranch Parkway Georgetown, TX 78628.
