29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    On or about April 25, 2018 two employees were exposed to noise levels exceeding 85dBA as an 8 hour time weighted average.    a.  Employee operated a horizontal band saw to cut pallets apart and a cross cut saw to cut wood pieces to length. Employee was sampled on April 25, 2018 and was exposed to 99.94 dBA as an 8 hour time weighted average.    b.  Employee was using a pneumatic nail gun when assembling wood pallets.  Employee was sampled on April 25, 2018 and was exposed to 89.03 dBA, as an 8 hour time weighted average.

29 CFR 1910.134(a)(2): A respirator was not provided by the employer to each employee when such equipment was necessary to protect the health of the employee:      On or about April 25, 2018, employees were not wearing respiratory protection when cutting wood pallets and wood pieces with a saw inside had particulates not otherwise regulated (total dust) exposure that exceeded the OSHA 8hour time weighted average of 15.0 mg/m3.    An employee  engaged in wood cutting activities on April 25, 2018 was exposed to particles not otherwise regulated (total dust) as an 8 hour time weighted average of 17.5mg/m3, approximately 1.16 times the permissible exposure limit of 15.0 mg/m3; this limit was established to prevent adverse health effects.  The exposure level was derived from two samples collected over 461 minutes, the remaining 19 minutes was calculated as zero (0) exposure time.
