29 CFR 1910.95(c)(1):  The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  On or about June 07, 2023, employees dismantling and building wood pallets were exposed to noise levels exceeding 90 dBA, on 90 dB threshold, and a continuing, effective hearing conservation program was not maintained in that an audiometric testing program was not maintained.  a.  On June 07, 2023, an employee operating a horizontal band saw,  a hammer and a pneumatic nail gun and was exposed to an 8-hour time-weighted average sound level of 96.57 dBA.  Employee was sampled for 270 minutes, the remaining 90 minutes was calculated as 0 (zero) exposure time.     b.  On June 07, 2023, an employee using a pneumatic nail gun was exposed to an 8-hour time-weighted average sound level of 93.74 dBA.  Employee was sampled for sampled for 471 minutes, the remaining 9 minutes was calculated as 0 (zero) exposure time.  Adame Pallets LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.95(c)(1), which was contained in OSHA inspection number 1301659, citation number 1, item number 1 and was affirmed as a final order on July 24, 2018, with respect to a workplace located at 2117 North Stoughton Road in Madison, WI 53704.

Adame Pallets LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.212(a)(3)(ii), which was contained in OSHA inspection number 1301659, citation number 1, item number 3 and was affirmed as a final order on July 24, 2018, with respect to a workplace located at 2117 North Stoughton Road in Madison, WI 53704.
