29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.    a. On or about March 15, 2018, located at 723 Viola Drive in Sunbury, Ohio, employees were framing a residential home at a height of approximately 13 feet without fall protection and not wearing eye protection while operating a nail gun.  The employer never initiated or maintained and safety and health programs to protect the employees from the hazards associated with performing framing work on a residential home.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.    a. On or about March 15, 2018, located at 723 Viola Drive in Sunbury, Ohio, employees were operating a pneumatic nail gun without any means of eye protection, thereby exposing the employees to an eye injury.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.      a. On or about March 15, 2018, located at 723 Viola Drive in Sunbury, Ohio, employees were installing 1st deck flooring without any means of fall protection, thereby exposing the employees to a fall hazard of approximately 13 feet.

On or about March 15, 2018, located at 723 Viola Drive in Sunbury, Ohio, employees were framing a residential home at a height of approximately 13 feet without fall protection and not wearing eye protection while operating a nail gun. The employer never instructed employees in the recognition and avoidance of unsafe conditions with the regulations applicable to framing a residential home in order to protect the employees from associated safety and health hazards.
