29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    On or about November 30, 2017, and at times prior thereto, employees were stacking highway concrete barriers in the storage yard approximately 15 feet high without fall protection, exposing employees to a fall hazard.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    The employer did not provide a training program for all employees exposed to fall hazards while conducting concrete barrier stacking operations.  The program shall include training and instruction in the following areas:    a)  The recognition and identification of fall hazards in the work area;  b)  The use and operation of guardrail systems (including perimeter safety cable systems), personal fall arrest systems, positioning device systems, fall restraint systems, safety net systems, and other protection to be used;  c)  The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used;  d)  The procedures to be followed to prevent falls to lower levels and through or into holes and openings in walking/working surfaces and walls; and  e)  The fall protection requirements of this subpart.

On or about November 30, 2017, and at times prior thereto, the employer did not ensure highway concrete barriers being stacked in the holding yard were rigged by qualified riggers, exposing employees to the hazards of being struck by suspended loads.

29 CFR 1926.1425(d): The employer did not ensure that only employees needed to receive a load were within the fall zone when a load is being landed.    On or about November 30, 2017, and at times prior thereto, the employer did not ensure that employees were located a safe distance from the load until it was safely landed and were out of the fall zone while stacking highway concrete barriers, exposing employees to the hazards of being struck by the load.
