OSH ACT of 1970 Section (5)(a)(1): It is alleged that the Employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm: a.) MVP Pipeline, Sutton WV: Employees were located too close to trees while they were being felled. NOTE: Among other methods, one feasible and acceptable abatement method to correct this condition is to follow the guidelines in ANSI Z133.1 2012, Safety Requirements for Arboricultural Operations, regarding working distances from trees being felled.

29 CFR 1910.136(a): The employer did not ensure that each affected employee used protective footwear when working in areas where there was a danger of foot injuries due to falling or rolling objects, or objects piercing the sole, and where such employee's feet were exposed to electrical hazards: a.) MVP Pipeline, Sutton WV: On or about 03/25/18, employees performing manual felling with chainsaws wore steel toe boots in lieu of heavy-duty logging boots.
