29 CFR 1910.28(b)(3)(iv): The employer did not ensure each employee was protected from falling into a ladderway floor hole or ladderway platform hole by a guardrail system and toeboards erected on all exposed sides, except at the entrance to the hole, where a self-closing gate or an offset must be used. 29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): Employees were exposed to chemical hazards. The employer failed to assess the hazards within the basement room beneath the grain elevators main office to determine the correct personal protective equipment needed during its renovation. While cleaning the floor employees were exposed to inhalation and fire hazards from the Strypeeze paint remover and its chemical constituents including acetone, methylene chloride, Stoddard Solvent, and toluene.
