29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated: (a) On or about March 28, 2018, the employer did not ensure that employees were restrained within the Snorkel TB37 aerial lift bucket to prevent ejection while egressing a roof, approximately 21 feet above ground. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.453(b)(2)(vi): Boom and basket load limits specified by the manufacturer were exceeded: (a) On or about March 28 2018, the employer did not ensure that the basket load limits specified by the aerial lift manufacturer were not exceeded. Four employees were exposed to falls approximately up to 21 feet while egressing a roof on a Snorkel TB37 aerial lift that had a load capacity for two occupants only. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").
