Construction, Inc. at 1801 South Bahnson Avenue, Sioux Falls, SD 57103: On or about and at times prior to April 2, 2018, the exposing employer did not ensure that each employee that was installing wall sheathing with the use of a pneumatic nail gun was protected from flying particles by the use of appropriate eye protection. The condition exposed employees to eye injuries.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    (a) M.E.N. Construction, Inc., at 1801 South Bahnson Avenue, Sioux Falls, SD 57103: On or about and at times prior to April 2, 2018, the exposing employer did not ensure that employees were protected from falls while employees were engaged in the installation of exterior wall sheathing off of a temporary platform. Employees were working from an elevated work platform attached to the Ingersoll Rand All-Terrain forklift. This condition exposed employees to a fall hazard of approximately 19 feet.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:  (a)M.E.N. Construction, Inc. at 1801 South Bahnson Avenue, Sioux Falls, SD 57103: On or about and at times prior to April 2, 2018, the exposing employer did not ensure employees were protected from serious injury associated with an elevated work platform that was not connected to the mast of the Ingersoll Rand All-Terrain forklift.  This condition exposed employees to a fall hazard and crushing hazards related to the platform separating from the mast and/or forks.  Abatement note:  Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that all platforms used for elevating personnel with a rough terrain forklift truck comply with the design requirements specified in ASME/ITSDF B56.6-2001, American Society of Mechanical Engineers/Industrial Truck Standards Development Foundation, "Safety Standards for Rough Terrain Forklift Trucks", Section 8.24.1, Platforms for Elevating Personnel, in the following area: Paragraph (h) which states, "a means to securely attach the platform to the lifting mechanism, and to prevent the platform from inadvertent pivoting."

Construction, Inc. at 1801 South Bahnson Avenue, Sioux Falls, SD 57103: On or about and at times prior to April 2, 2018, the exposing employer did not ensure that each employee working on the third floor of the multi-family residence under construction were protected from fall hazards. Employees were working on the northeast corner of the third floor near a patio door opening without a fall protection system. This condition exposed employees to an approximately 19-foot fall hazard.

This condition exposed employees to a fall hazard of up to 19-feet.
