29 CFR  1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:  (a)M.E.N Construction, Inc. at 5725 East Mohogany Circle, Sioux Falls, SD 57110: On or about and at times prior to February 9, 2021, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were exposed to fall hazards of approximately 15 feet while installing roof sheathing with no fall protection systems in place while working outside the personnel basket positioned at the edge of the roof. The condition exposed employees to a fall hazard greater than 15 feet.   Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

Employees were conducting roof sheathing operations and were working outside of the personnel basket positioned at the edge of the roof.  This condition exposed employees to fall hazards of  approximately 15 feet.  M.E.N Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1305897, citation number 1, item number 3, and was affirmed as a final order on July 17, 2018, with respect to a workplace located at 1801 South Bahnson Avenue, Sioux Falls, SD 57103.
