29 CFR 1910.178(m)(4): The employer shall prohibit arms or legs from being placed between the uprights of the mast or outside the running lines of the truck. On or about April 3, 2018, forklift operators did not maintain their body (head and shoulders) inside the running lines of the lift due to obstructed views exposing employees to struck-by hazards.

29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle. On or about April 3, 2018, the Lantech Stretch Wrapper (Model: Q300XT, Serial Number: QX050113) did not provide any guarded to prevent employees from being struck while in operation.

29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. On or about the week of March 26, 2018 the Nissan 50 Optimum #32 propane forklift had damaged tire(s) which included deep cracks and gouging and was not taken out of service.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. On or about April 3, 2018 the powered industrial vehicles were not inspected on a daily basis to ensure that it was in safe working order exposing employees to struck-by hazards.
