29 CFR 1926.102(a)(1): Employees were not provided with eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents: (a) New residential construction located on Lot #75, Rear Roof: On or about 04/04/2018, and at times prior, the employer exposed employees to struck-by hazards while operating pneumatic framing nail guns at 120 PSI, in that protective eyewear was not provided to employees engaged in plywood sheathing installation. Employees operating these tools were exposed to struck-by hazards which included plastic collated fragments, wood debris and 3-inch fasteners. (b) New residential construction located on Lot #75, West gable wall: On or about 04/04/2018, and at times prior, the employer exposed employees to struck-by hazards while operating pneumatic framing nail guns at 120 PSI, in that protective eyewear was not provided to employees engaged in plywood sheathing installation. Employees operating these tools were exposed to struck-by hazards which included plastic collated fragments, wood debris and 3-inch fasteners.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) New residential construction located on Lot #75, Rear roof: On or about 04/04/2018, and at times prior, the employer exposed employees to fall hazards while working from a 10/12 pitched roof at eave heights of 10-feet, 4-inches from the lower level, in that a fall protection system was not provided to employees installing plywood sheathing.
