29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest systems. On 4/12/2018, employees from Scott-Lee Guttering Company were installing gutters on the roof of a residential building located on lot 686 on Mule Creek Drive in Wentzville, MO. An employee was not utilizing guardrail systems, a safety net system, or personal fall arrest systems while working from the roof. He was observed on an 8/12 sloped roof of the building approximately eight feet above the ground without fall protection, exposing him to a fall to the ground below. Scott-Lee Guttering Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1230721, citation number 1, item number 1, issued on 5/17/2017, and was affirmed as a final order on 5/25/2017, with respect to a workplace located on lot 22D Montrachet (528 Montrachet Drive), OFallon, MO.
